Richard Shuster beats Douglas Zahm, P.A., SunTrust and Seterus at Trial.

Firm attorney Richard Shuster won another trial against Douglas Zahm, P.A., a firm widely regarded as one of the toughest firms that represents banks and loan servicers in Florida foreclosure cases.  The trial was conducted in Brevard County, Florida.  This foreclosure case was originally filed by SunTrust but after two years of litigation Seterus replaced SunTrust as the servicer.  The Zahm firm knew that our firm was not one to surrender.  Since our firm beat the Zahm firm in another trial in late 2014, they took an additional precaution of bringing two witnesses to trial, one from the new servicer Seterus (who traveled from Oregon) and another witness from SunTrust.

Our firm won the case on two separate issues:  First because the original note had an endorsement that was not contained on the copy of the note attached to the complaint the Court sustained our objection to the original note being admitted into evidence.  The Court also agreed that the notice of default sent by SunTrust was legally inadequate and did not comply with paragraph 22 of the mortgage.  After the Plaintiff put on their case at trial and rested, firm attorney Shuster moved for involuntary dismissal, which the Court granted. 



Our clients in this matter are a Space Coast family with school age kids that suffered the loss of a good job due to disability.   Our client’s household income after the job loss, is less than half the amount necessary to qualify for loan modification.  Had our firm lost the trial our clients were at risk of being homeless.  As with every trial, our firm was All In.  We conducted extensive discovery, deposed the corporate representative who testified at trial, and searched high and low to find weaknesses in the bank’s case.  The night before the trial, our client got an E-mail, just a few minutes before midnight to let him know his lawyer was finally going home and was ready.  Thankfully our efforts paid off.

Shuster & Saben Defeats US Bank & Douglas Zahm PA in Foreclosure Appeal

In 2011, firm attorney Richard Shuster obtained the dismissal of a foreclosure case filed against a Brevard County law enforcement officer.  After the case was dismissed our firm filed a motion for attorney’s fees to recover money from U.S. Bank to reimburse as much as possible of the fees paid by the homeowner to our firm and to recover payment for the portion for our time that was spent on a pure contingency fee basis.  (Under our firm’s retainer agreement, a substantial portion of the time spent on the case is on a contingency fee basis meaning unless we win the case and recover fees from the bank we do not get paid for the time).  On January 12, 2012, a fee hearing was conducted before Brevard Circuit Judge John D. Moxley, Jr. to determine the amount of attorney’s fees US Bank would have to pay.  The case had numerous hearings after U.S. Bank’s lawyers, Douglas Zahm, P.A. had objected to almost all of the homeowner’s discovery requests, and our firm had to repeatedly go to Court to obtain orders overruling the bank’s objections and ordering the bank to provide discovery.

The time sheet filed by Douglas Zahm’s office showed they had worked approximately seventy hours by the time the bank moved for summary judgment.  Ultimately our firm worked over 100 hours on the case before we obtained a dismissal.  At the fee hearing the Court awarded 95 of the 101 ours we requested. After adding expert witness fees, costs, and interest, the attorney fee judgment against U.S. Bank came to $46,878.20.  This judgment was the largest fee judgment rendered against a bank in Brevard County in 2012.  The hours were much higher in this case because both firms fought the case very hard and “went to the mat.”

U.S. Bank brought in Lee L. Haas, a board certified business litigation attorney to handle the appeal.  Firm attorney, Richard Shuster, who handled the case at the trial level, fought on for the homeowner in the appeals Court.   While this was the firm’s first foreclosure appeal, Shuster had prior appellate experience in the First and Third District Court’s of Appeal.  The firm handled the appeal on a pure contingency fee basis, meaning the client paid no fees to our firm while the appeal was pending and the firm would only get paid if we won the appeal and appellate attorney’s fees were awarded.  During the fifteen months the appeal was pending our client paid nothing for attorney’s fees and made no mortgage payments.  The firm will now collect the original trial level fee award from the appellate bond paid by US Bank and seek additional appellate fees for writing an appellate brief that was approximately 40 pages long.  To view a redacted copy of the 5th DCA’s Per Curium Affirmed Opinion clink here.  A Per Curium Affirmed opinion means the appellate Court unanimously found that the trial Court did not commit any errors.

Shuster & Saben obtains $46,878 fee judgment against U.S. Bank



J.R. Ewing of TV drama Dallas was fond of saying “revenge is a dish best served cold.” In January of 2012, our firm obtained a judgment for attorney’s fees and costs against US Bank for in excess of $46,000.00. Our client’s revenge was served cold, approximately six months after a judge dismissed US Bank’s foreclosure case. In a foreclosure case when the bank loses the bank has to pay the prevailing homeowner’s attorney’s fees and costs. In this case, firm attorney Richard Shuster, spent 101 hours defending the case, and the Court, found that 95 of the hours were reasonable. The Court ordered U.S. Bank to pay the firm 95 hours at $450.00 per hour ($42.500.00) together with $3,562.50 of expert witness fees, $500.00 of interest, and $65.00 of costs.

This was the largest attorney fee judgment against a bank or loan servicer the firm has ever obtained and is one of the largest fee awards awarded in Brevard County in a foreclosure case. In this case U.S. Bank went to the mat. At mediation the lender offered our client a token interest rate reduction of less than 1% that would have cut the clients mortgage by less than $50.00 a month. Our client, a county employee, had lost most of his overtime compensation in the wake of government cutbacks that were widespread in the Space Coast, after the housing bubble burst causing property tax revenues to fall off a cliff. Our client owed nearly double what his home was worth. At mediation, we tried to convince U.S. Bank that their case was not a slam dunk but the attorney for U.S. Bank was a “coverage” attorney brought in just for mediation because he had an office in Melbourne. The banks coverage attorney saw the file for the first time the day of mediation. For more than two hours, attorney Shuster pointed out to bank several of the serious obstacles they would face if they proceeded and some of the wholes in their case. US Bank was cocky and complacent. Their position was that they would win and that the homeowner’s choice was to either take the banks crappy offer or lose their house. Our client made another choice. He choose to stay the course and fight.
